Georgia Law on Complete Stops & Rolling Stops

O.C.G.A. § 40-6-72 requires a driver approaching a stop sign to stop at the marked stop line. If there isn’t one, the driver must stop before entering the crosswalk or, when no crosswalk exists, at the point nearest the intersecting roadway where approaching traffic can be seen.

A complete stop means the wheels cease all forward motion. Slowing down without fully stopping is a rolling stop and can support a citation. The statute doesn’t set a minimum number of seconds for remaining stationary, but the driver must yield to any traffic presenting an immediate hazard before proceeding.

Georgia Stop Sign Ticket Penalties

A conviction under O.C.G.A. § 40-6-72 adds three points to a Georgia driver’s license. Under Georgia’s point system, accumulating 15 points within 24 months can result in license suspension. Paying the citation produces the same licensing consequences as a conviction entered in court.

Failure to stop is generally charged as a misdemeanor traffic offense. Georgia misdemeanor penalties can include fines up to $1,000 plus court costs and, in rare cases, up to 12 months in jail, though jail time is seldom imposed for a routine stop sign violation.
