Our Georgia traffic ticket attorneys have significant experience in handling traffic tickets for commercial drivers who are cited with a Georgia speeding ticket or Georgia traffic ticket. A commercial driver's CDL will be suspended for a wide variety of Georgia traffic ticket convictions including moving violations and non moving violations such as speeding, expired license and driving while out of service. Georgia traffic law provides that a commercial driver's license will be suspended if convicted of two "serious traffic violations" within a three-year period as measured from the dates the commercial driver received the tickets. Many other states have the same or a similar traffic ticket law as its relates to commercial drivers. Under Georgia traffic ticket law a "serious traffic violation" includes speeding 15 or more miles per hour above the posted speed limit, reckless driving, following too closely, improper or erratic lane change, and failure to signal a lane changes as well as many other Georgia traffic ticket offenses. Georgia traffic law also states that a commercial driver's license will be suspended if convicted of a "major offense". A "major offense" includes but is not limited to DUI, hit and run or leaving the scene of an accident, failure to report striking an unattended vehicle, failure to report striking a fixed object, failure to report an accident, driving a commercial motor vehicle while the person's commercial driver's license or commercial driving privilege is revoked, racing, fleeing or attempting to elude, operating a motor vehicle with a revoked registration as well various other Georgia traffic ticket offenses. Georgia traffic law also provides that a "serious traffic violation" or "major offense" occurs for a commercial driver with a CDL whether the CDL driver receives a conviction for a Georgia traffic ticket in a commercial vehicle or a non-commercial vehicle. Many commercial drivers and even some Georgia traffic ticket attorneys believe that a plea of no contest which is also known as nolo contendere for a Georgia speeding ticket or Georgia traffic ticket will save a CDL license from being suspended if the Georgia traffic ticket offense qualifies as a "major offense" or "serious traffic violation" under Georgia traffic ticket law. This is WRONG! Georgia traffic ticket law does NOT distinguish between whether an offense occurs within a commercial vehicle or non-commercial vehicle for a CDL.
